Hereinafter referred to as the “Seller”.
Article 2 – Purpose
These General Terms and Conditions of Sale define the rights and obligations of the parties in connection with the online sale of products offered by the Seller on the Figurine & Kawaii website.
Any order placed on the website constitutes full and unconditional acceptance of these General Terms and Conditions of Sale.
Article 3 – Products
The products offered for sale are described and presented as accurately as possible.
Photographs, illustrations and visuals displayed on the website are provided for illustrative purposes only and are not contractually binding on the Seller.
Products are offered for sale subject to availability.
Article 4 – Prices
Prices are displayed in euros (€).
For customers located within the European Union, the prices displayed include the applicable VAT where VAT is due.
Delivery costs are displayed before the final confirmation of the order.
The Seller reserves the right to modify its prices at any time. Products are invoiced based on the price applicable at the time the order is confirmed.
Article 5 – Orders
An order is considered final once the shopping cart has been validated, the information required for delivery and payment has been provided, and the full price has been paid.
Before finally confirming the order, the customer has the opportunity to review the details of the order, its total price and correct any errors.
Confirmation of the order constitutes acceptance of these General Terms and Conditions of Sale, which are available at any time on the website.
The Seller reserves the right to refuse or cancel any order in the event of a previous dispute with the customer, fraud, or reasonable suspicion of fraud.
Article 6 – Payment
Payment is due immediately when the order is placed.
The payment methods accepted are those offered on the website at the time of the order.
Transactions are secured by the payment service providers used by the website.
The Seller never stores the customer's complete banking details.
Article 7 – Delivery
The Seller delivers products to:
- Metropolitan France;
- Belgium;
- Germany;
- Italy;
- Mainland Spain (excluding the Balearic Islands, Canary Islands, Ceuta and Melilla).
Any order placed for delivery to an area that is not served may be refused or cancelled before dispatch.
Products are delivered to the address provided by the customer when placing the order.
Delivery times displayed on the website are estimates and are provided for information purposes only.
The Seller shall not be held liable for delays attributable to the carrier, administrative authorities, force majeure, or any circumstances beyond the Seller's reasonable control.
Article 8 – Transfer of Risk
The risk of loss or damage to the products shall pass to the customer when the customer, or a third party designated by the customer other than the carrier, physically takes possession of the products.
Article 9 – Order Cancellation
The customer may request cancellation of an order provided that the order has not yet been processed or prepared for dispatch.

Once the order has been processed or dispatched, cancellation may no longer be technically possible.
The customer nevertheless retains their statutory right of withdrawal in accordance with Article 10.
Article 10 – Right of Withdrawal
In accordance with the provisions applicable to consumers within the European Union, the customer has a period of fourteen (14) calendar days from receipt of the last item of their order to exercise their right of withdrawal without having to provide a reason.
To exercise this right, the customer may:

After notifying the Seller of their decision to withdraw, the customer has fourteen (14) days to return the products.

Article 11 – Returns and Refunds

Unless the return is due to an error on the part of the Seller or to a defective product upon receipt, return shipping costs are borne by the customer.
Once the returned products have been received and inspected, the refund will be issued using the payment method used for the original order.
The refund will be issued no later than fourteen (14) days from receipt of the returned products or from the date the customer provides proof of shipment of the return.
Article 12 – Statutory Conformity Guarantee
Consumers benefit from the statutory conformity guarantee provided for under Articles L.217-3 et seq. of the French Consumer Code.
The consumer has a period of two years from delivery of the goods to exercise their rights under this guarantee.
Where a product does not conform to the contract, the consumer may request its repair or replacement under the conditions provided for by the applicable regulations.
Article 13 – Guarantee Against Hidden Defects
Consumers also benefit from the statutory guarantee against hidden defects provided for under Articles 1641 to 1649 of the French Civil Code.
This guarantee allows the consumer to request cancellation of the sale or a reduction in the purchase price in accordance with the applicable legal provisions.
Article 14 – Intellectual Property
All elements of the Figurine & Kawaii website, including but not limited to texts, images, logos, graphics, videos and other content, are protected by intellectual property rights.
Any unauthorised reproduction, representation, distribution or exploitation is prohibited.
Article 15 – Personal Data
Personal data collected in connection with the use of the website and the placing of orders is processed in accordance with the Privacy Policy available on the website.
The customer has the rights provided for under the General Data Protection Regulation (GDPR) and applicable regulations.
Article 16 – Applicable Law and Dispute Resolution
These General Terms and Conditions of Sale are governed by French law.
In the event of a dispute, the parties shall first seek an amicable resolution.
If no amicable agreement can be reached, the competent courts shall be determined in accordance with the applicable legal provisions.
Consumers may also refer the matter to a consumer mediation service in accordance with the provisions of the French Consumer Code, provided that the Seller has communicated the contact details of the relevant mediator.
Article 17 – Amendments to the General Terms and Conditions
The Seller reserves the right to amend these General Terms and Conditions of Sale at any time.
The General Terms and Conditions applicable to an order are those in force on the date the order is confirmed.
